spider pen plastic was broken when it came in

can this be fixed or do i need to send it back for a replacement ?? the motor works perfect but the other half of the pen is cracked the plastic where the cap goes.. also it is almost impossible to change battarys.. because the part you twist is broken . and was when it came in.. ive only had it for about 3 days .
